Man sentenced in armed robbery, fatal 2021 shooting at gas station in Greeley

DENVER — A man convicted Monday in an armed robbery and a fatal shooting at a Greeley gas station in 2021 will spend the rest of his life in prison.

Kyle Moore, who was 28 years old at the time, was suspected of being involved in the armed robbery and shooting that took place at a Cosmic Market gas station on December 14, 2021. The incident resulted in the death of 51-year-old Victor Martinez.

Moore was convicted on all charges related to the crime earlier on the same day. The charges against him included first- and second-degree murder, various counts of aggravated robbery, assault, and vehicle theft.

Additionally, Moore admitted guilt to being in possession of a firearm as a repeat offender after the jury had exited the courtroom. Subsequently, he was handed a sentence to serve in the Colorado Department of Corrections later the same Monday.

Besides the mandatory sentence to life in prison for first-degree murder, Moore was also sentenced to 64 years for the other charges, which will run both consecutively and concurrently.

“You committed the ultimate crime of taking another person’s life,” Judge Kopcow said during Monday’s sentencing hearing. “Someone who did nothing to you.”

Moore also has three other cases pending — two alluding cases and motor vehicle theft case. The judge decided to resolve those while he serves his time at the CDOC.

“This was senseless,” Deputy District Attorney Timothy McCormack said. “This defendant has shown a complete disregard for human life. It’s heartbreaking that the victim’s family now must live with a life sentence of grief and loss. Mr. Martinez was simply doing his job – trying to earn a living – when his life was cruelly taken from him.”
