Josey recalls his mom telling him, “Don’t be silly!” when he expressed fear about swimming. As they swam further from their rental boat, Rivera noticed it drifting away and attempted to return to it with Josey. Dorsey revealed that Josey remembers his mother calling out his name just before she went under the water and vanished from sight. The boy has also mentioned that he was too frightened to use a rope with a life raft because there was a spider on it—a detail that continues to haunt him, as he feels he could have saved her.
The incident resulted in a wrongful death lawsuit against Ventura County, which was settled in 2022 for Josey’s benefit. Dorsey expressed regret over not being there during those crucial moments and wonders what might have happened if he had been present.
