Judge urged to keep injunction on Trump’s anti-DEI orders

An association that holds a membership and has succeeded in obtaining a countrywide court order against a decree aimed at “diversity, equity, and inclusion” (DEI) initiatives is urging a federal judge to uphold the initial ruling.

In the final days of January, President Donald Trump signed executive orders with the aim of eradicating DEI initiatives from contracts with the federal government and prohibiting government contractors from having their own DEI programs. In addition, Trump instructed the U.S. Attorney General to discourage such initiatives or principles and to explore the possibility of commencing investigations into “civil compliance” to enforce such discouragement.

On February 21, U.S. District Judge Adam B. Abelson, who was appointed by President Joe Biden, released a preliminary nationwide injunction against all three directives opposing DEI. The judge concluded that these directives violate the right to freedom of speech and are inherently unclear in their meaning.

On Feb. 25, the government filed a motion to stay the court’s order pending appeal along with a memorandum arguing the injunction “intrudes on the Executive’s authority to enforce the law.”
