A teacher from upstate New York has been accused of raping a student after an in-depth investigation prompted by allegations from an incident that occurred in December.
David W. Porter, 66, faces charges of raping a minor under the age of 17 and was subsequently released from jail on his own recognizance on Saturday, as reported by WHAM. Despite objections from prosecutors, the court released him but did issue an order of protection for the child.
According to FingerLakes1.com, prosecutors strongly opposed the decision not to set bail, but their concerns were disregarded by the court. School officials clarified that the alleged incident did not occur on school premises.
Victor Central Schools immediately placed Porter on leave and is seeking the suspension of his teaching credentials, WHAM said.
“These circumstances are distressing,” said Victor Central Schools Superintendent Dr. Timothy Terranova. “The safety and well-being of our school community is of the highest importance. Additional support and resources will be available on Monday for students and staff. If you or your child are in need of immediate support, please contact your child’s principal. The school will send out information as law enforcement allows.”
Terranova also said the district is fully cooperating with investigators, who said the victim was not currently enrolled in any of Porter’s classes.
Porter is due in court on March 4.
