SCOTUS Hands Trump a Major Win on Use of Alien Enemies Act to Deport Some Illegals

The Supreme Court handed President Trump a significant win against a federal judge who has been a staunch critic of Trump and a favorite of anti-Trump supporters. In a 5-4 decision, with Justices Sotomayor, Kagan, Jackson dissenting and Justice Barrett partially dissenting, the Court ruled in favor of President Trump’s ability to utilize the Alien Enemies Act to deport Venezuelan gang members. The Court also nullified all orders issued by Judge James Boasberg, clearly signaling its dissatisfaction with the judge by stating that the “venue is improper in the District of Columbia.”

Since then, the legal dispute has primarily revolved around a clash between the US Department of Justice and Judge Boasberg, who was upset when government lawyers failed to redirect a plane carrying Venezuelan criminals back to the US. RedState has extensively covered this ongoing battle.
