A former agent with the U.S. Drug Enforcement Administration who allegedly participated in the Jan. 6 Capitol attack attempted to use President-elect Donald Trump’s recent comments on NBC’s “Meet the Press” regarding pardoning rioters to delay his trial, without success.

Mark Sami Ibrahim, from Orange County, California, filed a motion to postpone his federal case in Washington, D.C. following Trump’s interview. Ibrahim, a former DEA special agent, stands accused of being involved in the Jan. 6 riot at the Capitol where he purportedly brandished his government-issued firearm and badge. The Department of Justice reported that he also asked a friend to capture images of him during the attack, which were then shared in a WhatsApp group with at least five other law enforcement officers.

His delay request was shot down by U.S. District Judge Timothy J. Kelly, with support from federal prosecutors.

“The Court is not inclined to postpone the stipulated trial based on uncertain events that may or may not involve this specific Defendant,” wrote Kelly, a Trump appointee, in a minute order uploaded to the federal docket on Monday. Kelly directed the stipulated trial to commence on the scheduled date of Jan. 23, 2025. In a stipulated trial, an option chosen by several high-profile accused Jan. 6 rioters, both the defendant and prosecutors agree on a set of facts that underlie the judge’s final decision.
