The Trump administration is being accused in a lawsuit filed in a Maryland federal court of attempting to significantly change and reshape civil rights law in the context of public education. According to the lawsuit, the government is seeking to overhaul existing regulations.

On Valentine’s Day, the civil rights division of the U.S. Department of Education issued a letter addressed to educational institutions that receive federal funding. In this communication, institutions were cautioned against using race preferences and stereotypes in various aspects of their operations, including admissions, hiring, promotions, compensation, scholarships, and discipline. Non-compliance could lead to investigations and the loss of federal funding.

The lawsuit, spanning 37 pages, argues that the DOE’s instructions distort the current legal landscape while claiming to only reaffirm established legal obligations. The plaintiffs assert that this initiative violates the First Amendment, Fifth Amendment, and a relevant federal law that governs the activities of administrative bodies.

“The Department of Education is attempting to establish a new legal regime when it has neither the lawmaking power of Congress nor the interpretative power of the courts,” the filing reads. “The Letter fails to provide definitions and objective standards for assessing discrimination in violation of Title VI, or to assess what conduct is lawful. Thus, its references to discrimination and nondiscrimination are too vague to give clear notice of what conduct is supposedly prohibited.”
