Some Walgreens customers who paid for prescription drugs using insurance may be eligible for payments as part of a proposed class action settlement. 

Walgreens agreed to the $100 million settlement following a class action lawsuit alleging it overcharged some people for generic prescription drugs, according to attorneys representing the plaintiffs and court records. The settlement has not been finalized.

The class action complaint accused the pharmacy chain of wrongfully requiring customers with insurance to pay more for generic drugs than members of Walgreens’ Prescription Savings Club. That program, which ended on Aug. 31, 2024, allowed members who paid an annual fee to buy hundreds of generic drugs at set prices without using insurance. 

In a statement to VERIFY, a Walgreens spokesperson acknowledged the proposed settlement but said the company does not admit any wrongdoing.

“We admit no liability and believe these claims never had any merit. We launched the Prescription Savings Club (PSC) more than 15 years ago to provide equitable access to lower-cost medications for the uninsured and underinsured,” the spokesperson said.

“This resolution allows us to focus on our turnaround strategy that will benefit our team members, patients, customers and shareholders,” they added. 

According to court records, the official settlement website is savingsclubsettlement.com, which is included on the emailed notices that VERIFY readers received.

Who qualifies for the settlement

Anyone in the U.S. who paid for one or more prescription drugs from Walgreens between Jan. 1, 2007, to Nov. 18, 2024, and used insurance benefits to fill the prescriptions, is eligible for the settlement, the official website says. 

The potential payments for eligible Walgreens customers will vary. According to the official settlement notice, the exact amount people may receive from the settlement fund will depend on how much they and other members of the settlement class paid for prescription drugs.

People who are eligible for the settlement need to submit claims – and documentation, if required – by April 17, 2025, the settlement website says. 

The claim form asks you to estimate how much you paid out-of-pocket for eligible prescription drugs from Jan. 1, 2007, through Nov. 18, 2024. 

People who received a settlement notice and ID number from the settlement administrator do not need to provide any documentation at this time if their estimated total spending is less than $10,000, according to the settlement notice. But “the settlement administrator may ask for additional proof supporting your claim,” the notice says.

Anyone who didn’t receive a notice and ID number, or people who claim to have paid more than $10,000 for eligible prescription drugs, will need to provide documents to support their claims, the settlement notice says.

It’s unclear exactly when people who are eligible for the settlement could receive their payments. 

The next hearing for the settlement is currently scheduled for Sept. 10, 2025. If the court officially approves the settlement, payments could be sent sometime after that date.
