Don Wells has been jailed for 11 months after a DUI arrest
The Tennessee father of missing Summer Wells has been jailed for 11 months after admitting driving under the influence.
Don Wells, whose six-year-old daughter has been missing since June, appeared at Hawkins County General Sessions Court Monday where he pleaded guilty to the October DUI.
A toxicology screen from the night of his arrest showed no evidence of drugs but he registered a 0.13 blood alcohol percentage, above the 0.08 intoxication limit.
The state dropped all other charges from the October 30 arrest which was Wells’ first DUI.
Wells said on the night in question, he ‘wanted to get away’ after an argument with his wife Candus Bly.
General Sessions Judge Todd Ross told him: ‘That’s what feet are for.’
Shortly after the arrest, his family put out a statement saying: ‘There are no words to what each day and night is like. We needed cigarettes. It was a stupid decision. Please keep us in prayer. Keep Don. This pain wont go away. thank you.’
The mandatory minimum sentence is 48 hours in jail, 88 hours of community service, a $350 fine and a year with a revoked license.
But the arrest violated a previous probation order after he was arrested for possession of a handgun while intoxciated.

He must now serve the rest of his 11-month and 29-day sentence at the Hawkins County Jail.
He will be eligible for probation after 180 days if he completes an alcohol rehabilitation program.
Wells said in a note passed to News Channel 11: ‘Thanks to everyone for all positive support. It’s been very difficult.’
He added that he and Bly are taking classes to regain custody of their other children and he had been working a full-time job at the time of his arrest.
Summer was reported missing from her Rogersville home on June 15 around 5.30pm after her parents said she went into the basement alone and then vanished.

Her disappearance had sparked a 13-day search in the area around the home with few leads, and Wells told podcast host Jennifer Youngblood that his daughter’s disappearance has fueled rumors and theories, which had begun to affect him.
Summer’s three brothers were then taken into protective custody after Don admitted that he had taken to drink amid rumors about the girl’s disappearance.
Last week, Summer’s family released an emotional video on her sixth birthday as the hunt to find her continues.

Her family posted a heartbreaking video on YouTube to mark her birthday featuring pictures of at least 31 other missing children, between the ages of five and 17, including Camden Lamont Thomas, Reagan Mack, Lina Sardir Kim, Kaitlyn Langford, Janiah Bradley, Camden Rayner, Deangelo Maclin, America Shell, Joshua Cortes Gordillo, Kenya Marable, Michael Vaughan.
An emotional prayer is read out during the video which shows birthday cupcakes with Summer’s name in icing and cuddly toys.
Her parents said: ‘This is a tender day to us. We miss our Summer with all our hearts.
‘Thank You Everyone for helping us restore our Family and find our Daughter Summer Moon-Utah Wells.’
