He’s choosing not to take it.
In 2019, the actor from “Empire” alleged that he was attacked by two individuals wearing MAGA hats during a cold Chicago night while getting a Subway sandwich. Criticism of his account was highlighted with the statement, “His story was so full of holes, it made Swiss cheese jealous.”
Recently, Smollett settled a civil lawsuit with the city by agreeing to donate $50,000 to a local charity of his choice. Shortly after, he continued to assert his innocence despite substantial evidence suggesting otherwise.

On Instagram, Smollett accused the city of Chicago of participating in a conspiracy to undermine his report of being a victim of a hate crime.
“Over six years ago, after it was reported I had been jumped, City Officials in Chicago set out to convince the public that I willfully set an assault against myself. This false narrative has left a stain on my character that will not soon disappear,” Smollett wrote.
“These officials wanted my money and wanted my confession for something I did not do. Today, it should be clear…They have received neither,” he continued.
