MS-13 gang member arrested by ICE previously released due to sanctuary policy

An MS-13 gang member, who had been arrested by federal immigration authorities in Massachusetts just last week, found himself in a tricky situation. He was already facing state gun charges and had even been directed to be deported in the past. In a surprising turn of events, he was actually released by a Boston court despite all this.

Luis Adolfo Guerra Perez, 19, a Guatemalan citizen, was arrested by U.S. Immigration and Customs Enforcement (ICE) agents on Jan. 22.

Subsequently, on Jan. 3, things took a serious turn for him when he was arraigned at an East Boston District Court. The charges against him included possessing a large capacity weapon/firearm, having a class D controlled substance, being in possession of a firearm without a permit, and having ammunition in his possession.

Despite being a known member of a gang and having serious drug and gun charges pending against him, the court decided to disregard a request from ICE detainer due to local sanctuary policies. Astonishingly, the court ordered Guerra’s release on Jan. 22, raising eyebrows in the process.

He remains in federal custody.
