A 35-year-old man in Pennsylvania faces rape and battery charges after a woman was s*xually assaulted aboard a public transportation train Wednesday night when passengers witnessed the attack but did not intervene, authorities said Friday.
The woman was assaulted around 11 p.m. her as she rides the Southeastern Pennsylvania Transportation Authority (SEPTA) Market-Frankford line to the city of Upper Darby.
Police Identified
Police identified Fiston Ngoy of Philadelphia through surveillance footage that captured him s*xually assaulting a woman Wednesday night aboard a Southeastern Pennsylvania Transportation Authority (SEPTA) train to the city of Upper Darby.
Upper Darby Police Superintendent Timothy Bernhardt said that while there were other people on the train, it was ultimately a SEPTA employee who called 911, allowing officers to arrest Ngoy on the spot.
“It’s worrying that there are definitely people in the L, and no one stepped in or did anything to help this woman,” Bernhardt told NBC 10.

Statement
“The assault was observed by a SEPTA employee, who called 911, allowing SEPTA agents to respond immediately and detain the suspect on the spot,” SEPTA spokesman Andrew Busch said in a statement.
Arrested and Charged
SEPTA agents arrested the man, later identified as 35-year-old Fiston Ngoy, according to Upper Darby Police Superintendent Timothy Bernhardt.
Surveillance video captured the entire assault, providing investigators with enough evidence to charge Ngoy with rape and assault, Bernhardt told NBC Philadelphia.
Video Evidence
The video also shows how the passengers, who also witnessed the attack, did nothing to help the assaulted woman, according to Bernhardt.
“It’s disturbing,” she said. “I’m in shock, I have no words for it. I just can’t imagine seeing what you were seeing through your own eyes and seeing what this woman was going through without anyone stepping in and helping her.”
Investigators are also reviewing the videos in an effort to determine who was there and interview potential witnesses, Bernhardt added.
