A retired company director who was caught drink driving near his £1million home and punched a police officer after he was arrested has been banned from driving for three and a half years. 

Brian Wilson, 75, was stopped by police in his Volvo car on Golf Links Road in Ferndown, Dorset just after 8pm on December 8.

Officers noticed he was slurring his words and smelt of alcohol. A breathalyser confirmed he had 80 mcg of alcohol in 100ml of breath – more than twice the legal limit of 35mcg.

Poole Magistrates’ Court heard that after being arrested, the pensioner punched a police officer after becoming upset about being held in custody.  

Wilson has now been disqualified from driving for three-and-a-half years following his latest conviction.

He was previously caught drink-driving on in 2017 when he had just left a Christmas party at a £2,000-a-year Ferndown Golf Club and was found to be over the limit and banned from driving for 17 months. 

David Finney, prosecuting, said: ‘While speaking to him, the officer smelt that he was intoxicated and noted his speech was slurred and his eyes were glazed.

‘A roadside breath test was carried out, which he failed and he was arrested.’

Mr Finney said the pensioner became ‘volatile and aggressive’ while he was held in a police cell.

He said: ‘While in custody, the police have a duty of care and due to his age the nurse felt she needed to check on him.

‘She’s not allowed to go to the cells on her own so she was accompanied by PC Matt Cave.

‘The defendant was extremely volatile and aggressive, saying it was a disgrace that he was in custody at 75, saying he was dying and saying he should not be staying here and should be released.

‘He was told he would be with the police until they were satisfied he was sober enough to be released. He was asked to pipe down and listen to the nurse.

‘PC Cave then felt he was going to be assaulted so he pushed him very gently on his chest to push him out of his space.

‘He was reminded again to calm down and he then punched the officer, but didn’t cause an injury.’

He told police he could not understand the reading as he had only had one glass of wine.

Wilson pleaded guilty to charges of drink-driving and assault.

The magistrates ordered him to pay a total fine for the two offences of £652, as well as prosecution costs, victim surcharge and compensation to PC Cave, which brought the total to £852.
