Buck resolution calls Harris to aim to invoke 25th Amendment

Republican Rep. Ken Buck of Colorado has put forward a resolution that calls for Vice President Kamala Harris to seek the invocation of the 25th Amendment against President Joe Biden.

The resolution states that the House calls for Harris “to immediately use her powers under section 4 of the 25th Amendment to convene and mobilize the principal officers of the executive departments in the Cabinet to declare what is obvious to a horrified Nation: That the President is unable to successfully discharge the duties and powers of his office.”

The resolution says that the House calls for Harris “to transmit to the Speaker of the House of Representatives and the President pro tempore of the Senate notice that she will immediately assume the powers and duties of the office as Acting President.”

The resolution, which points out that Biden is the oldest president in the nation’s history, says, among other things, that the president “has been televised wandering aimlessly at events,” “frequently speaks publicly in an incoherent and indiscernible manner,” and “has repeatedly fallen while walking up stairs.”

Biden, who is currently aiming for re-election, would be 86 years old by the end of a second term in office.

Buck, who has been in office since 2015, is not seeking re-election this year.

Earlier this month, Buck was one of the House Republicans who voted against impeaching Department of Homeland Security Sec. Alejandro Mayorkas. Last year, Buck was one of the House Republicans who joined Democrats in voting to oust then-Rep. Kevin McCarthy from the House speakership.

“President Biden has proven that he is no longer fit for office. His cognitive decline and lack of mental stamina has been both public and undeniable. I call on Biden’s Cabinet to constitutionally remove him from office, using the 25th Amendment,” Buck declared in a social media post.

Section four of the 25th Amendment states, in part, “Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.”
